Terms of Service

Please read these Terms carefully before using My Country Mobile's services. By accessing or using the Service, you agree to be bound by these Terms.

1. Agreement to Terms

These Terms of Service (“Terms”) are a binding agreement between you and My Country Mobile Pte Ltd, operating as My Country Mobile (“MCM,” “we,” “us”), governing your access to and use of mycountrymobile.com and the MCM communications services, including virtual numbers, voice, messaging, and applications (the “Service”).

By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind it.

2. Definitions

“Customer” means the person or organization that subscribes to the Service. “End User” means an individual who uses the Service through a Customer. “Account” means your registered account. “Content” means data, messages, and recordings transmitted or stored through the Service.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration information, for safeguarding your credentials, and for all activity under your Account. Notify us promptly of any unauthorized use.

4. Acceptable Use

Your use of the Service is subject to the MCM Acceptable Use Policy (AUP), which is incorporated into these Terms by reference. Violation of the AUP is a breach of these Terms.

5. Service Description and Changes

We provide cloud communications services and may add, change, or remove features over time. Features identified as beta or trial are provided “as is” and may be modified or discontinued. We do not guarantee uninterrupted or error-free service.

6. Telecommunications Terms

  • Numbers: telephone numbers assigned to you are licensed, not sold, and remain subject to carrier and regulatory requirements, including number portability and local eligibility rules in each country.
  • Emergency calling (E911): where supported, emergency calling over VoIP has important limitations described in the AUP. You acknowledge those limitations and agree to keep your registered service address current and to inform your end users.
  • Regulatory compliance: you are responsible for using the Service in compliance with telecom laws applicable to your traffic, including TCPA, robocall-mitigation, and 10DLC/A2P messaging rules.
  • Traffic and fraud: we may monitor, throttle, route, or block traffic to protect the network, prevent fraud, and meet legal obligations.

7. Fees and Billing

Fees, billing cycles, and payment terms are as stated in your order or plan. Prepaid balances and rates are as published or quoted. Unless stated otherwise, fees are exclusive of taxes and regulatory surcharges, which you are responsible for. Late or failed payments, or a depleted prepaid balance, may result in suspension.

8. Third-Party Services

The Service may interoperate with third-party carriers, networks, and integrations. We are not responsible for third-party services, and your use of them is subject to their terms.

9. Intellectual Property

We and our licensors own all rights in the Service, including software, designs, and trademarks. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your Content and grant us the rights needed to provide the Service.

10. Privacy

Our handling of personal data is described in the MCM Privacy Policy, incorporated by reference. Where we process Customer or End User personal data on a Customer's behalf, the applicable Data Processing Agreement governs that processing.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.

13. Indemnification

You will defend and indemnify MCM against claims, damages, and costs arising from your Content, your use of the Service, your traffic, or your breach of these Terms or the AUP, including any unlawful calling or messaging.

14. Suspension and Termination

We may suspend or terminate the Service for breach of these Terms or the AUP, non-payment, suspected fraud, or legal/regulatory reasons. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

15. Governing Law and Disputes

⚠️ The dispute resolution mechanism (arbitration vs. court jurisdiction) is pending legal review. This section will be updated before publication.

These Terms are governed by the laws of Singapore, without regard to conflict-of-laws rules. The parties will attempt to resolve disputes informally; unresolved disputes are subject to the exclusive jurisdiction of the courts of Singapore.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance.
